IntroductionBartolus of Saxoferrato is well known because of his ideas on the autonomy of the populus or civitas.1 He asserts that the populus can claim autonomous jurisdiction as a result not only of imperial concession but also of prescription, custom, or even eventual use on the ground of a de facto situation. Thus, the populus (...) needs no authorization from a superior, not even the emperor, to make its own laws. The idea of an autonomous populus did not originate with Bartolus, however. Marsilius of Padua had already worked out a quite developed theory about the authority of the whole body of the citizens to legislate.2 As opposed to the Aristotelian Marsilius, however, Bartolus bases his opinion about the populus essentially on the Corpus Iuris,3 though he knew at least the Politics and the Ethics too.4 What is important is not whether his knowledge of Aristotle [End Page 369] was immediate or through Giles of Rome's De Regimine Principum but that he proves his ideas basically by showing that they agree with certain authoritative texts and that he considers the Corpus Iuris, not Aristotle, as the proper authority to support his opinion on the populus.Such an emphasis on the autonomy of the civitas must not conceal the fact that, unlike Marsilius, Bartolus introduces the pope and the emperor alongside the populus as having jurisdiction of their own. Nor must the omnipresence of the Corpus Iuris hide the significance of the Bible in relation to the issue of the empire. Indeed he turns to the Scriptures not to substantiate the autonomy of the populus but to establish the divine origin of the royal (and papal) jurisdiction in general. Moreover, he uses them along with a particular interpretation of the popular origin of the empire to present the imperial jurisdiction as not subordinate to the populus.The concept of an autonomous civitas based in human premises, therefore, coexists in Bartolus with a notion of imperial power established by God, the former being inseparable from the latter, by virtue of his use of authorities. In fact Bartolus turns to the Corpus Iuris and the Scriptures not simply to illustrate but to substantiate his point of view. The authority of the Corpus Iuris, however, which supports his views on the populus, comes from the fact that emperor Justinian was its autor. But the Corpus Iuris is by the same token less authoritative than the Scriptures, whose author is God and which support the divine origin of the imperial power. Thus, working out a theory grounded on the authority of the Corpus Iuris, Bartolus also favors the base on which the imperial power was founded.The texts of interest here are the De Regimine Civitatis, De Guelphis et Gebellinis, and De Tyranno, where Bartolus more systematically presents his political ideas. In the De Regimine Civitatis he is concerned about "how many ways there are of governing a city,""which is the better way" and "which is the worst."5 The De Guelphis et Gebellinis treats both old and "recent" meanings of these nouns, whether these factions are licit, and the criteria to prove to which one belongs. At last the De Tyranno explains the origin of the word and the characteristics of the tyrant. Having discussed if there can be tyrant in a neighbourhood, household, and city, Bartolus divides the tyrants in the civitas into manifest, concealed, and tacit, and discusses whether their acts are valid. In tackling all of these issues, he turns to different sorts of proof—several authorities, including the Corpus Iuris, Scriptures, Aristotle, Giles of Rome, Gregory I, and Aquinas, as well as the jurisdictions of the populus, pope, and emperor. Os sofistas defendiam a impossibilidade de provar a falsidade ou veracidade dos discursos. Tais pensadores baseavam-se no interdito ontológico de Parmênides de Eleia, que preconizava, em linhas gerais, a existência de uma estrita correspondência entre tudo que pode ser dito e o ser, de forma que seria, assim, impossível, dizer algo que não é, ou seja, um não-ser. Contrariando tal perspectiva (...) e fazendo uso do método da _diaíresis _– em que os seres são caracterizados por suas diferenças mais fundamentais –, o _Sofista _se desenrola revisitando e revisando as teorias ontológicas de seu tempo, a fim de explorar uma nova forma de pensar a relação entre os seres. Platão assegura, com isso, a possibilidade de análise qualitativa do discurso predicativo e define, consequentemente, o erro como desarmonia entre o dizer e o ser. Este esbozo pretende una lectura de Latinoamérica desde una nueva base epistemológica ‘dejando sin habla’ los supuestos metafísicos mediante una retirada a la metáfora de los signos de los tiempos en su emergencia original. Para lo cual se exponen las metáforas de la infancia (...) como emergencia de una nueva era, entendida como inversión cósmica y epistemológica, las metáforas relativas al martirio y a la señal de Jonás, y finalmente, exponemos metáforas que relacionan revelación y signos de los tiempos, para esto estudiamos las metáforas del ‘pasar a la otra orilla’ y las del ‘enigma’ y la interrogación. One important limitation of the current renditions of interpretivism is that its emphasis on the moral dimension of sport has overlooked the aesthetic dimension lying at the core of this account of sport. The interpretivist’s failure to acknowledge and consider the aesthetic implicitly distances this realm from the moral. Marcia Muelder Eaton calls this distancing the separatist mistake. This paper argues that interpretivism presupposes not only moral but also aesthetic principles and values. What it sets out to demonstrate is that (...) interpretivism is an integralist, or nonseparatist, account of sport, one in which ethical and aesthetic values are not exclusive. Making explicit and specifying interpretivism’s combined moral-aesthetic approach to sport not only helps to better distinguish the whole range of values that make up sport as well as their interconnection but also encourages sportspeople to pursue more coherent sport and, thus, more enriching lives. Is the procreation asymmetry intuitively supported? According to a recent article in this journal, an experimental study suggests the opposite. Dean Spears (2020) claims that nearly three-quarters of participants report that there is a reason to create a person just because that person’s life would be happy. In reply, I argue that various confounding factors render the study internally invalid. More generally, I show how one might come to adopt the procreation asymmetry for the wrong reasons by misinterpreting one’s intuitions.

In 1939, the influential psychophysicist S. S. Stevens proposed definitional distinctions between the terms ‘number,’ ‘numerosity,’ and ‘numerousness.’ Although the definitions he proposed were adopted by syeveral psychophysicists and experimental psychologists in the 1940s and 1950s, they were almost forgotten in the subsequent decades, making room for what has been described as a “terminological chaos” in the field of numerical cognition. In this paper, I review Stevens’s distinctions to help bring order to this alleged chaos and to shed light on (...) two closely related questions: whether it is adequate to speak of a number sense and how philosophers can make sense of the claim by cognitive scientists that numbers are perceptual entities. Moreover, I offer further support to Stevens’s distinction between numerosity and numerousness by showing that they are relational properties that emerge through different relationships between agents and their environments. The final conclusion is that, by adopting Stevens’s distinctions, numbers do not need to be seen as perceptual entities, since the so-called number sense is better described as a sense of numerousness. This paper offers a unified explanation for the procreation asymmetry and the non-identity thesis – two of the most intractable puzzles in population ethics. According to the procreation asymmetry, there are moral reasons not to create lives that are not worth living but no moral reasons to create lives that are worth living. I explain the procreation asymmetry by arguing that there are moral reasons to prevent the bad, but no moral reasons to promote the good. Various explanations for the (...) procreation asymmetry have failed to explain the non-identity thesis: if one could create a person with a good life or a different person with a better life, one has a moral reason to create the better life. I argue that reflections on the misfortune of unfulfilled potential allow us to circumvent the non-identity problem. (shrink)

This chapter explains Franz Brentano's metaethical theory and how it purports to deal with such difficulties. Brentano explains correctness in emotions by analogy with correctness in judgements. For a judgement to be correct is for it to concord with a judgement made by someone who judges with self-evidence (Evidenz). Self-evident judgements are guaranteed to be correct, and they are based either on "inner perception" or on presentations of objects that are rejected apodictically. Brentano's metaethical theory concerns first and foremost the (...) psychology of valuing and of moral judgement. Brentano is clearly a cognitivist about evaluative and moral judgement; such judgements are judgements about the correctness of feelings, and judgements are cognitive acts. However, one aspect of his position that seems congenial to contemporary expressivism. This has to do with expressivist treatments of disagreement. Brentano's views seem akin to the kind of foundationalist intuitionism that is traditionally associated with non-naturalism. (shrink)

It is common in contemporary sport to liken the notion of the team to that of the family. That is, the family is used to evoke team life. Portraying the team as a family usually implies a positive evaluation. Despite its prevalence, the team as a family equation has not been analyzed in the sport philosophy literature. Thus, the purpose of this article is twofold. First, it explores whether the team is to be equated with the family. To discuss the (...) nature of the family and the team, I draw together the work of several sport philosophers with that of Laura Wildemann Kane. Second, and considering what characterizes the team, this article investigates whether teammates have special responsibilities to one another by virtue of their relationship and the value attached to it. I propose that the team as a family equation does not align with the constitution of these two social groups and that teammates have special responsibilities to one another, but such responsibilities are different from those observed in the family. Is there a pro tanto moral reason to create a life merely because it would be good for the person living it? Proponents of the procreation asymmetry claim there is not. Defending this controversial no reason claim, some have suggested that it is well in line with other phenomena in the moral realm: there is no reason to give a promise merely because one would keep it, and there is no reason to procreate merely to increase the extent of justice (...) in the world. Allegedly, some analogs extend so far as to support a unified theory of the no reason claim and the nonidentity thesis, that is, the view that of two persons leading lives of positive wellbeing, there is a reason to create the person with higher wellbeing. I dismantle the proposed analogs and show that they fail to meet various desiderata. Moreover, I refute Johann Frick's argument that the no reason claim follows from the assumption that reasons of beneficence are reasons to act for the sake of people. By criticizing attractive defenses for the no reason claim, I weaken its plausibility. (shrink)

Despite society’s increasing sensitivity toward green production, companies often struggle to find effective communication strategies that induce consumers to buy green products or engage in other environmentally friendly behaviors. To add clarity to this situation, we investigated the effectiveness of negative versus positive message framing in promoting green products, whereby companies highlight the detrimental versus beneficial environmental consequences of choosing less versus more green options, respectively. Across four experiments, we show that negatively framed messages are more effective than positively framed (...) ones in prompting consumers to engage in pro-environmental behaviors. More importantly, we find that anticipated shame is the emotion responsible for this effect. Furthermore, both environmental concern and the type of product promoted serve as moderators; thus, the mediating role of anticipated shame is attenuated when environmental concern is low and the product is a luxury one. Finally, we discuss the theoretical and managerial implications of our work, along with its limitations and some directions for future research. (shrink)

Experiences—visual, emotional, or otherwise—play a role in providing us with justification to believe claims about the world. Some accounts of how experiences provide justification emphasize the role of the experiences’ distinctive phenomenology, i.e. ‘what it is like’ to have the experience. Other accounts emphasize the justificatory role to the experiences’ etiology. A number of authors have used cases of cognitively penetrated visual experience to raise an epistemic challenge for theories of perceptual justification that emphasize the justificatory role of phenomenology rather (...) than etiology. Proponents of the challenge argue that cognitively penetrated visual experiences can fail to provide the usual justification because they have improper etiologies. However, extant arguments for the challenge’s key claims are subject to formidable objections. In this paper, I present the challenge’s key claims, raise objections to previous attempts to establish them, and then offer a novel argument in support of the challenge. My argument relies on an analogy between cognitively penetrated visual and emotional experiences. I argue that some emotional experiences fail to provide the relevant justification because of their improper etiologies and conclude that analogous cognitively penetrated visual experiences fail to provide the relevant justification because of their etiologies, as well. We discuss the idea that superpositions in quantum mechanics may involve contradictions or contradictory properties. A state of superposition such as the one comprised in the famous Schrödinger’s cat, for instance, is sometimes said to attribute contradictory properties to the cat: being dead and alive at the same time. If that were the case, we would be facing a revolution in logic and science, since we would have one of our greatest scientific achievements showing that real contradictions exist.We analyze that (...) claim by employing the traditional square of opposition.We suggest that it is difficult to make sense of the idea of contradiction in the case of quantum superpositions. From a metaphysical point of view the suggestion also faces obstacles, and we present some of them. (shrink)

How does history relate to the past? According to leading historical theorists, the relation to the past in history is reducible to evidential, psychological, practical and retrospective concerns. In contrast, this volume claims that historical relations to the past are irreducible products of the logical commitments of history as method. Ahlskog argues that the method of history shapes and enables relations to past in historical research by invoking past perspectives of meaning for rendering reality intelligible. Following J.-Y.Béziau in his pioneer work on non-standard interpretations of the traditional square of opposition, we have applied the abstract structure of the square to study the relation of opposition between states in superposition in orthodox quantum mechanics in [1]. Our conclusion was that such states are contraries, contradicting previous analyzes that have led to different results, such as those claiming that those states represent contradictory properties. In this chapter we bring the issue once again into the center of the (...) stage, but now discussing the metaphysical presuppositions which underlie each kind of analysis and which lead to each kind of result, discussing in particular the idea that superpositions represent potential contradictions. We shall argue that the analysis according to which states in superposition are contrary rather than contradictory is still more plausible. (shrink)

In this work, we focus on a very specific case study: assuming that quantum theories deal with “particles” of some kind, what kind of entity can such particles be? One possible answer, the one we shall examine here, is that they are not the usual kind of object found in daily life: individuals. Rather, we follow a suggestion by Erwin Schrödinger, according to which quantum mechanics poses a revolutionary kind of entity: non-individuals. While physics, as a scientific field, is not (...) concerned with whether entities posited by a specific physical theory are individuals or not, answering this question is part of the quest for a better understanding of physical reality. Aristotle normally used historical notations to support his arguments. This is somewhat true for all the works of the corpus, but above all for Politics: the nature, objectives, and methodology of the investigations in this treatise present the strongest links with actual and concrete data, and therefore with historia. Obviously even the Aristotle of Politics is not a historian who wants to report known historiographical traditions; however, regardless of his intentions, there is no doubt that the work in question contains (...) precious ‘fragments’ of history which, in general, confirm or supplement our knowledge. There are, however, cases in which the Aristotelian exempla end up filling in the omissions and gaps of the available sources, such as the cursory reference to the nomos of the Aphytaians, which appears in the section of book 6 dedicated to the so-called agricultural democracy. The strategy of developing an ontology or models of disability as a prior step to settling ethical issues regarding disabilities is highly problematic for two reasons. First, key definitional aspects of disability are normative and cannot helpfully be made value-neutral. Second, if we accept that the contested concept of disability is value-laden, it is far from obvious that there are definitive reasons for choosing one interpretation of the concept over another. I conclude that the concept of disability is better left (...) ethically open-ended or broad enough to encompass the examination of various ethical issues. Alternatively, the concept of disability could be altogether abandoned in order to focus on specific issues without being hindered by debates about the nature of disability. Only political costs, rather than conceptual considerations internal to the models, could be weighed against such a conclusion. (shrink)

This paper concerns how extant theorists of predictive coding conceptualize and explain possible instances of cognitive penetration. §I offers brief clarification of the predictive coding framework and relevant mechanisms, and a brief characterization of cognitive penetration and some challenges that come with defining it. §II develops more precise ways that the predictive coding framework can explain, and of course thereby allow for, genuine top-down causal effects on perceptual experience, of the kind discussed in the context of cognitive penetration. §III develops (...) these insights further with an eye towards tracking one extant criterion for cognitive penetration, namely, that the relevant cognitive effects on perception must be sufficiently direct. Throughout these discussions, we extend the analyses of the predictive coding models, as we know them. So one open question that surfaces is how much of the extended analyses are genuinely just part of the predictive coding models, or something that must be added to them in order to generate these additional explanatory benefits. In §IV, we analyze and criticize a claim made by some theorists of predictive coding, namely, that (interesting) instances of cognitive penetration tend to occur in perceptual circumstances involving substantial noise or uncertainty. It is here that our analysis is most critical. We argue that, when applied, the claim fails to explain (or perhaps even be consistent with) a large range of important and uncontroversially interesting possible cases of cognitive penetration. We conclude with a general speculation about how the recent work on the predictive mind may influence the current dialectic concerning top-down effects on perception. (shrink)

Scientific realism is typically associated with metaphysics. One current incarnation of such an association concerns the requirement of a metaphysical characterization of the entities one is being a realist about. This is sometimes called “Chakravartty’s Challenge”, and codifies the claim that without a metaphysical characterization, one does not have a clear picture of the realistic commitments one is engaged with. The required connection between metaphysics and science naturally raises the question of whether such a demand is appropriately fulfilled, and how (...) metaphysics engages with science in order to produce what is called “scientific metaphysics”. Here, we map some of the options available in the literature, generating a conceptual spectrum according to how each view approximates science and metaphysics. This is done with the purpose of enlightening the current debate on the possibility of epistemic warrant that science could grant to such a metaphysics, and how different positions differently address the thorny issue concerning such a warrant. Nonrelativistic quantum mechanics (QM) works perfectly well for all practical purposes. Once one admits, however, that a successful scientific theory is supposed not only to make predictions but also to tell us a story about the world in which we live, a philosophical problem emerges: in the specific case of QM, it is not possible to associate with the theory a unique scientific image of the world; there are several images. The fact that the theory may be compatible with distinct (...) ontologies, and that those ontologies may themselves be associated with a plurality of metaphysical approaches, gives rise to the problem of metaphysical underdetermination. This paper concludes that the available metametaphysical criteria fail to deliver objectivity in theory choice, and it puts forward its own criterion based on a tension between two methods of metaphysical inquiry: one that is closely related to science and another that is not. In this opinion piece, I briefly argue, against certain recent claims, that the Non-Identity Problem is indeed a significant problem for any comparative personal view – views on which the moral status of an act (at least partly) depends on the comparative relation between a property F of some person P as a consequence of that act and F of P as a consequence of the relevant alternative(s).

In this paper we deal with two applications of the square of opposition to controversial issues in the philosophy of quantum mechanics. The first one concerns the kind of opposition represented by states in superposition. A superposition of “spin up” and “spin down” for a given spatial direction, for instance, is sometimes said to originate particular kinds of opposition such as contradictoriness. The second application concerns the problem of identical particles. Identity and indiscernibility are entangled in discussions of this problem (...) in such a way that a proper conceptual treatment of those issues through the square seems profitable. (shrink)

A close examination of the literature on ontology may strike one with roughly two distinct senses of this word. According to the first of them, which we shall call traditional ontology , ontology is characterized as the a priori study of various “ontological categories”. In a second sense, which may be called naturalized ontology , ontology relies on our best scientific theories and from them it tries to derive the ultimate furniture of the world. From a methodological point of view (...) these two senses of ontology are very far away. Here, we discuss a possible relationship between these senses and argue that they may be made compatible and complement each other. We also examine how logic, understood as a linguistic device dealing with the conceptual framework of a theory and its basic inference patterns must be taken into account in this kind of study. The idea guiding our proposal may be put as follows: naturalized ontology checks for the applicability of the ontological categories proposed by traditional ontology and give substantial feedback for it. The adequate expression of some of the resulting ontological frameworks may require a different logic. We conclude with a discussion of the case of orthodox quantum mechanics, arguing that this theory exemplifies the kind of relationship between the two senses of ontology. We also argue that the view proposed here may throw some light in ontological questions concerning this theory. (shrink)

The first decade of event-related potential (ERP) research had established that the most consistent correlates of the onset of visual consciousness are the early visual awareness negativity (VAN), a posterior negative component in the N2 time range, and the late positivity (LP), an anterior positive component in the P3 time range. Two earlier extensive reviews ten years ago had concluded that VAN is the earliest and most reliable correlate of visual phenomenal consciousness, whereas LP probably reflects later processes associated with (...) reflective/access consciousness. This article provides an update to those earlier reviews. ERP and MEG studies that have appeared since 2010 and directly compared ERPs between aware and unaware conditions are reviewed, and important new developments in the field are discussed. The result corroborates VAN as the earliest and most consistent signature of visual phenomenal consciousness, and casts further doubt on LP as an ERP correlate of phenomenal consciousness. (shrink)
